  • 📄 Title Insurance Turns 150—and the Problem It Solved Is Back in the Headlines — The industry did not develop because examiners were careless. It developed because even a careful professional can reach a reasonable but incorrect legal conclusion, leaving the property owner with no recovery unless negligence can be proven. As policymakers experiment with opinions, waivers, and automated risk models, the anniversary is a useful reminder that finding the records and standing behind the result are not the same service.

  • 📄 The Bank Foreclosed on One Property—and Sold a Different One — An Alabama foreclosure went badly off course when the parties relied on an address, a physical description, and the borrower’s own assumption rather than confirming the legal parcel. The bank later conveyed a property with a legal description that did not match the land everyone thought was being sold, and the Alabama Supreme Court affirmed a $114,000 compensatory award against the bank. The article’s recommendation is wonderfully basic and painfully relevant: know your collateral, obtain the survey, and make sure the legal description matches the property everyone is standing in front of.

  • 📄 The “Title Company in a Box” 📦 Is Scaling Nationally — TitleEase says it is licensed in 46 states, onboarding five to ten franchises per month, and meeting with roughly 200 prospective brokerage partners monthly. Its model helps brokerages and lenders create and own title operations while the parent provides licensing, compliance, staffing assistance, technology, vendor relationships, and operating infrastructure. What happens to independent agencies when affiliated title ownership can be purchased as an operating system?

  • 🚨 Virginia Just Made Seller Identity Verification a Legal Duty for Settlement Agents — Effective July 1, Virginia settlement agents must exercise reasonable care in determining the seller’s identity, while all traditional and electronic notaries must keep records of notarial acts for five years. Additional notary training and local property-alert requirements arrive in 2027.
