• 🏛️ Title Insurance Is Back in the Congressional Hot Seat — ALTA CEO Chris Morton is urging Congress to pass the Protecting America’s Property Rights Act, a bill aimed at stopping Fannie Mae and Freddie Mac from shifting title risk onto consumers, lenders, and taxpayers through less-regulated title insurance alternatives. The bill would require stronger, state-regulated protection for title and lien risk on loans purchased by the GSEs. “Saving money at closing” gets a lot less charming when the missing protection shows up later as a six-figure title problem.

• 💬 Texas Title Folks, This One Might Actually Be Worth a Look. TDI is asking for public feedback on existing insurance rules that may be outdated, inefficient, or in need of improvement — and yes, that appears to include the title insurance rules housed under Texas Administrative Code Title 28, including Chapter 9 and the Title Insurance Basic Manual framework.

🚨 CertifID Moves the Closing Out of Email Jail — CertifID launched a unified closing platform that puts identity verification, document signing, payment, and wire instruction delivery inside one authenticated session. For title teams, the operational takeaway is simple: the market is pushing hard toward secure closing rooms because email is where money gets stolen.

⚖ Fair Lending Lawsuit Puts CFPB’s Regulation B Rewrite Back in the Blender — Fair housing and economic advocacy groups sued to stop CFPB changes to Regulation B/ECOA, arguing the rule weakens disparate-impact and discouragement protections. This is mortgage-side litigation, but title professionals should care because lending-rule turbulence can ripple into origination volume, lender procedures, and compliance expectations at the closing table.

💸 Title Premium Volume Jumped Nearly 14% in 2025 — ALTA reported $18.5 billion in 2025 title insurance premiums, up 13.8% from 2024, with claims still totaling more than $667 million. Good news for the industry, but not a victory lap: higher volume plus sophisticated fraud means ops teams still need clean workflows, sharp underwriting, and boringly excellent file discipline.

⚖️ Title Coverage Case Draws a Hard Line on Enforcement Actions and Marketability Claims — Riker Danzig flagged a May 26 case update involving title policy coverage, enforcement actions, and marketability claims. This is the kind of litigation title pros should watch because “covered defect” versus “business/legal problem near the property” is where claims expectations go to fight in a parking lot. Read on to find out if Marketable Title is the Same as Economic Marketability…

⚠️ OCC Finalizes Preemption Rule on State Interest-on-Escrow Laws — The OCC issued a final rule on whether certain state interest-on-escrow requirements apply to national banks and federal savings associations. This is more lender/banking than title-specific, but escrow interest rules can affect lender instructions, servicing expectations, and how settlement teams explain money-handling quirks to consumers.

🚨 Breaking News:

Flowers Just Blew Up FinCEN’s Real Estate Reporting Rule: On March 19, 2026, a federal judge in Texas didn’t just poke holes in FinCEN’s Residential Real Estate Reporting Rule…👉 He vacated it entirely.

• Friday news and differing legal opinions spread - some agents were told to stop filing, some were told to keep calm and carry on.

• Saturday, FinCEN finally spoke up and published the notice above on their website. It’s official, you can pause Real Estate Reporting - for now.

  • Personally, I’d recommend continuing to collect data while this plays out. As they say, it’s not over til the fat lady sings, and I don’t think she’s singing yet.

• Geographic Targeting Orders are still in force and effect. The latest was issued on March 10th and runs until Sept 2nd. Your read the details here.

• As of Friday, FinCEN was still accepting reports and this notice makes it sound like they will continue to do so should you chose to file anyway. 🦅FinCEN Report Company is standing by to assist you.

📰 Executive Order Seeks to Expand Mortgage Credit for Customers of Community and Smaller Banks (Read the Executive Order) (Timeline late 2026-2027)

• 📰 Trump’s mortgage order sets stage for regulatory shift, draws consumer backlash

  • Consumer advocates fear it could undermine protections, revive risky lending practices, cause discriminiation and lead to negative market conditions reminiscent of past crises.

📰 Executive Order seeks to remove regulatory barriers to affordable home construction.

📰 U.S. regulators propose lighter capital requirements for banks - If you’ve been in this industry long enough, your spidey sense is already tingling.
Because 2008 didn’t happen overnight—it happened through a series of “reasonable” steps:

  • The Senate approved the 21st Century ROAD to Housing Act, which includes a provision limiting institutional investors owning 350+ single-family homes from buying more.

  • Proponents claim this will enhance housing affordability, but economists argue data indicates minimal impact on the market.

  • A Realtor.com report shows institutional investors accounted for only 1% of all single-family home purchases from 2015 to 2025, and their market share has decreased from 12.2% in 2015 to 7.5% in 2025.
